1. Acceptance of Terms
By accessing and using the bookmymaxi.com.au website service, you agree to be bound by these Terms and Conditions. If you disagree, you must not use the Service.

2. The Service
We provide a technology platform that connects users with independent third-party providers of taxi and maxi cab transportation services. We are not a transportation carrier. The provision of rides is solely the responsibility of the Driver.

3. Bookings and Payments

• Fares are calculated based on factors like distance, time, and demand, and are provided as an estimate. The final fare may differ.
• You agree to pay the fare for any service requested through your account.

5. Cancellation Policy

• Users may cancel a booking, but a cancellation fee may apply if cancelled after a driver has been assigned or is en route.
• Drivers may also cancel a booking. We are not liable for any costs incurred due to a Driver cancellation.

6. User Conduct
You agree not to:

• Use the Service for any unlawful purpose.
• Cause nuisance, annoyance, or damage to any Driver or vehicle.
• Smoke or consume alcohol/drugs in the vehicle.
• Request a Driver to breach traffic or other laws.

7. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law:

• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability for any claim is limited to the amount of the fare for the relevant booking.
• We do not guarantee the availability, suitability, or safety of any Driver or vehicle. Your transportation contract is directly with the Driver.

8. Indemnity
You agree to indemnify us against any losses, liabilities, or costs arising from your breach of these Terms or your use of the Service.

9. Termination
We may suspend or terminate your access to the Service immediately, without notice, for conduct we believe violates these Terms or is harmful to other users, Drivers, or us.

10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.
